The agreement
These are the rules of playing Gods Of Myth. You accepted them when you first opened the game — the screen with the tick on it — and they are a binding agreement between you and the publisher.
The publisher is Johnathon Nicolaou, a sole trader based in Sydney, New South Wales, Australia, ABN 58 576 416 023. “We”, “us” and “our” mean him; “you” means the person playing.
If you do not agree to these terms, do not play the game. How your information is handled is a separate document: the Privacy Policy, which forms part of this agreement.
I. The short version
- You need an account, and you need to be at least 13.
- Drachma, cards and packs are not property and have no cash value. You are buying a licence to use them inside this game, and nowhere else.
- Packs are randomised. What each one guarantees is written on it before you buy.
- Some Ranked Arena opponents are computer-controlled. The ladder is filled out with them so there is always someone to fight.
- Play fairly. No cheating, no automation, no exploiting bugs, no abusing other players through your name.
- The game will change. Cards get rebalanced, features come and go, and one day it will be switched off.
- Nothing here takes away your rights under the Australian Consumer Law, or any equivalent law where you live.
II. Your account
- You must be at least 13 — or older, where the law where you live sets a higher age for agreeing to something like this. The game is not designed for children.
- One person, one account. Keep your sign-in to yourself. Anything done through your account is treated as done by you, so tell us at once if you think somebody else has got into it.
- Accounts are not transferable. You may not sell, rent, gift or trade an account, a username, or anything inside one, and an account obtained that way may be closed without notice.
- Your username must be three to sixteen letters, numbers or underscores, and it must not impersonate somebody else, advertise anything, or be obscene, hateful or harassing. We may rename or reclaim a name that breaks that rule.
- Parts of the game need the internet — signing in, the cloud save, Ranked Arena and friend battles. We do not promise the service will always be available or uninterrupted.
III. What you may and may not do
You are granted a personal, non-exclusive, non-transferable, revocable licence to play Gods Of Myth on Apple-branded devices you own or control, for your own private entertainment. The game, its artwork, its writing, its card designs and its code stay ours.
You must not:
- cheat, or use any modified client, injector, macro, bot, script or automation;
- tamper with the game’s files, its network traffic, or the data it stores;
- reverse engineer, decompile or disassemble the game, except so far as the law expressly says you may despite this clause;
- deliberately exploit a bug, a pricing error or a loophole — if you find one, tell us at godsofmythsupport@gmail.com rather than farming it;
- get at another player’s account, or at parts of our systems not meant for you;
- use the game, a username or a friend-battle code to harass, threaten or abuse anyone;
- sell, stream commercially, or make any commercial use of the game or anything in it without our written permission.
IV. Drachma, packs and paying
What you are actually buying
Drachma, cards, alters, quest scrolls, trophies, season pass progress and everything else inside Gods Of Myth are a limited licence to use a feature of the game. They are not your property, not a currency, not an asset, and not a credit balance.
- They have no value outside the game and cannot be exchanged for money, goods or anything else of real-world value.
- They cannot be transferred, sold or traded between accounts.
- They expire, at the latest, when your account is closed or when the game stops operating.
- We may change what things cost, what they do, and how many of them a pack pays, as part of balancing the game.
Buying through the App Store
Real-money purchases are made through Apple’s App Store. Apple takes the payment; we never see or hold your card details. Your purchase is also subject to Apple’s own terms, and Apple’s prices and currency conversion apply.
Drachma bundles are consumable: they are added to your purse when Apple confirms the purchase and are gone once spent. Because they are consumed on delivery they cannot be restored later, which is ordinary for App Store consumables.
Randomised packs
Some packs contain randomly selected cards. What a pack guarantees — how many cards, and the least it promises about them — is shown on the pack before you buy it, and the guarantee is honoured on every pack. Beyond the guarantee, what you get is chance. Buy a pack for what it promises, not for a particular card.
The Season Pass
The premium season track is bought with drachma, not money, and it is not a subscription: nothing renews, and nothing is charged to your card. A season runs for the calendar month. When it ends, rewards you have earned but not collected are claimed for you automatically and the pass then resets for the new month.
Refunds
All purchases are final except where the law says otherwise. We cannot issue App Store refunds — Apple holds the transaction, so a refund request goes to Apple. Your rights under the Australian Consumer Law, and under any equivalent law where you live, are not affected by anything in this section: see section IX.
V. Playing with other people
Ranked Arena
The ladder runs in weekly seasons. Taking part publishes an entry other players can see — your name, your avatar, your record and the defence teams you set. What is published, and what happens to it if you delete your account, is set out in the Privacy Policy.
Friend battles
A friend battle is arranged by sharing a join code. Only share a code with someone you mean to play. Both devices run the battle, and a dropped connection may end it.
Conduct
There is no chat in Gods Of Myth, so the only thing you can say to another player is your name. Keep it civil. If somebody’s name or behaviour is a problem, write to godsofmythsupport@gmail.com with their name and what happened.
VI. Fair play, and what we may do about it
If we reasonably believe an account has been used to cheat, to automate play, to exploit a bug, to abuse another player, or to commit fraud — including a chargeback on goods already granted — we may do any of the following, with or without notice and in proportion to what happened:
- remove or reset ill-gotten drachma, cards or ladder standing;
- rename a username that breaks section II;
- remove an entry from a ladder or a season;
- suspend the account, or close it permanently.
Nothing bought is refunded when an account is closed for breaking these terms, except where a law requires it. If you think we have got it wrong, write to godsofmythsupport@gmail.com and we will look at it again.
VII. The game will change
Gods Of Myth is a live game. We may add, change, suspend, rebalance or remove any part of it at any time — cards, prices, odds, modes, rewards, the ladder, the season pass — and we may eventually stop operating the game altogether.
Where that happens, we are not obliged to compensate you for unspent drachma, uncollected rewards, an unfinished season or content you can no longer reach, except to the extent the Australian Consumer Law or another law that applies to you requires it. A balance change that makes a card you paid for less powerful is part of playing a live game, not a fault in it.
VIII. Ending this agreement
You can end it at any time by deleting your account — Delete account, beneath Sign out on the Profile screen — and removing the app. That destroys your account, your save and everything in it, as described in the Privacy Policy.
We may end it by closing your account under section VI, or if we stop operating the game under section VII.
Sections IV, VI, IX, X and XI survive the end of this agreement, along with anything else that by its nature should.
IX. Consumer rights, and the limits of our liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any equivalent right you have under the law where you live. Where the law allows us to limit our liability for breaching one of them, our liability is limited to resupplying the service, or paying the cost of having it resupplied.
Subject to that, and to the fullest extent the law permits:
- the game is provided as it is, and we do not promise it will be uninterrupted, error-free, or that a particular feature will always exist;
- we are not liable for indirect, incidental or consequential loss, lost profits, lost opportunity, or loss of data or progress beyond what section VII already covers;
- our total liability to you for everything arising out of this agreement is limited to the greater of one hundred Australian dollars or the amount you actually paid us for the game in the twelve months before the claim arose;
- we are not responsible for what another player does, for a failure of your device or your connection, or for a failure of a service we depend on and do not run.
X. Apple
Gods Of Myth is distributed through the App Store, and Apple requires the following to be said plainly:
- This agreement is between you and us, not Apple. Apple is not responsible for the game or its contents.
- Apple has no obligation to provide maintenance or support for the game. Support is ours, at godsofmythsupport@gmail.com.
- If the game fails to conform to any warranty that applies, you may tell Apple, and Apple may refund the purchase price. To the maximum extent the law permits, Apple has no other warranty obligation of any kind in relation to the game.
- We, not Apple, are responsible for any claim that the game fails to conform to a legal or regulatory requirement, for product liability claims, and for claims arising under consumer protection law.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the game infringes that party’s intellectual property.
- You confirm that you are not in a country subject to a United States Government embargo or designated by it as supporting terrorism, and that you are not on any United States Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
You must also comply with any applicable third-party terms — for example, Apple’s own App Store terms — when using the game.
XI. The rest of it
Changes to these terms
When these terms change in a way you ought to know about, the version number at the top of this page is raised and the game asks every player to read and accept them again on next launch — the same gate you saw when you first opened it. Carrying on playing after that is how you accept them. Minor corrections are made in place.
Governing law
These terms are governed by the law of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. If you live somewhere else, this does not take away the protection of any mandatory consumer law of the country you live in, or your right to bring a claim there.
General
- If any part of these terms is unenforceable, it is severed and the rest stands.
- If we do not enforce something straight away, we have not given up the right to enforce it later.
- These terms and the Privacy Policy are the whole agreement between us about the game.
- You may not assign this agreement. We may assign it if the game changes hands, on terms no worse for you.
